I loved how Sarah just hid Brianna's things under the dock. There is always an outcast every season and Brianna seems to be the one. And Greg.
Overall, Greg seems to be nice but then a jerk. He has shown change but then cancels it out with deciding to ditch Charna's lesson.

Irrespective of what Facebook publishes as its "policy," it does not supersede Federal Law. Is Sarah wishes to claim ownership under the DMCA, then she has every right to do so. I chase down intellectual property rights violations all the time and have not lost one case since 2000.

Actually I question the veracity of the argument. How can it be a DMCA violation when you take your property and place it on someone else's property and [I]digitally sign[/I] where it says - [B]I am giving you this property[/B]. That sounds to me like it is binding (although I am not a lawyer.) I have a feeling if Facebook wanted to make coffee mugs with this image (for profit) it would be well within their rights.. We will eventually see legal challenges to this online model and licensing, but to date there have not been any significant judgments to speak of (because it would be very expensive and you would probably lose.)
You have argued many DMCA cases successfully, but I doubt you have argued any where the copyright holder has passed on the rights. Even if it is not binding, Facebook would not want to lose such a case (as it would put their entire business model and website and jeopardy) and I am sure that you would be greeted by the calvary of lawyers that they have available. So I guess you have to decide if it is worth it.
It is not like this image was taken from a personal website. It was willfully given to Facebook and displayed publicly.
That being said, I am using it under the [B]Fair Use Doctrine[/B] in supplement to a news story on a public figure, just as CNN (and a hundreds of other news organizations) put up pictures of Ashley Alexandra Dupre from her myspace page (which has almost identical content copyright policies to Facebook) when the story on Elliot Spitzer broke a few months ago.
Intellectual property law is a hot mess. Were I on the other side of the question, I would take your position. I'm not. The law is just so much fun! ;)
Earlier this week, a news organization published on its web site a picture of a reality person recently in the news. They cited Fair Use doctrine in copying the image from a reality site that had pirated the original image from our web site which is clearly copyright labeled and image protected. Quite simply, the image was hacked by the reality site (imagine the dishonor). I spent several hours tracking down the offending parties, going through the motions of the DMCA cease and desist process and providing a list of precedent cases. With one phone call, the hosting ISP gave up the reality site owner's contact info. Six hours later the offending images were removed and the Fair Use argument never tested in court. We were fully ready to litigate with very expensive outside counsel. Bottom line: I take it personally when someone steals my property and I have the resources to be very nasty about it. :evilgrin:

The law is quite clear here (as Perez Hilton recently found out when taking images from photo services without paying royalties) and the current holder of the rights to the image was never in question. Thus your speedy work in coming to an amicable agreement (having the pictures removed.) Had you (the rights owner) posted that image to myspace and then found yourself in a similar situation - the path would not have been as clear.
I think there would be a flimsy argument to state that this image of Sarah in being displayed, dilutes the value of the original copyright holders possession (which is the argument that you could have obviously made) because the truth is there is no inherent value to the image other then a valid suppliment to the Devil/Angel news story that we are telling about this willfully public figure.

I think she actually has a fighting chance concerning Girls Gone Wild (at least in gaining a settlement) although suing the media en masse for "ripping" her myspace pages is only going to further the punchline status of her representation.
So I just caught up w/ this ep last night. A few things:
Sarah and Kim need to get off their high horse!! I am sooo sick of their **** with worrying about Bri!! (and I think that was my big rant w/ last weeks episode so I'll let it go....)
Why was it not a big deal for Kim and Dave to do it in the same room as Sarah but not Bri? I mean, you either mind it or you don't. It shouldn't depend on the person/people.
I hope Will does good on his music. Those beats he played for Sticky Fingers were awesome. The kind of stuff I could totally hear on the radio today. It's good that he can find a good balance between keeping his "work" obligations at IO, and [I]actively [/I](ahem...Bri) working on his dream of music.
Aside from Bri's past problems and addictions, there's something about her that makes me think she is more mature than Kim or Sarah. I don't know, I can't think of anything specific now....but there were several points in the episode where I thought she had it more together than those two.
Oh and this is from last week too....but I LOVED when Bri was on the phone w/ her mom and talking about Bobby and her mom's like "BRI, KNOCK IT OFF". Oh my goodness if I havn't heard that [I]same tone[/I] in my mom's voice when I needed to be snapped out of it!! I just really liked that part. I hope she listens to her mom :)

And I have to give Will credit for trying to pursue his dreams while there. I think this is the third instance of him doing such (playing music on the streets in the premiere, handing out demos at a promo party on another episode, and now this). I thought I was going to roll my eyes at this kid the whole season, but he's proved me wrong.
And props to Greg for pursuing modeling, though I think he's not that great at it. (And I had to laugh seeing this guy sitting back and getting a pedicure! That was too funny.)
I've heard Brianna's songs on her MySpace page and they're pretty decent. I just hope and pray she gets off her butt and starts pursuing this goal more. And I agree with Will---nix the smoking. Madam ReRe may be the Queen of Soul, but even she had that nasty habit of smoking which gave her health problems in the long run.
What have Sarah, Kim and Dave (almost forgot his name) done to pursue their goals since moving there? If Kim wants to work for E!, why hasn't she written a cover letter and sent a resume to them? Why hasn't Sarah contacted any news stations if she wants to be a reporter? And Dave, well, why hasn't he done ****? Lazy!

Well here comes the obvious response...
How do you know that each one has done nothing? All we know is what the editors chose to give us from the many hours of video available. Even then, we don't know if something was done off camera. If I had similar concerns, perhaps I would have written the following:

Hmm...could there be footage at the dailies site maybe? But I doubt they'd show anything "uninteresting" (not to me) as pursuing dreams on there. It's all about the hot tub ***.
Who knows...maybe in the last few episodes they'll show them making some progress.

Good to hear he was doing something! Guess he was yet another "victim" of reality TV editing. It's good to hear about those things, because I was about to remember him as "short drunken guy who brings home random girls and bops roommates he doesn't like with a rolled-up newspaper on their heads."

Sarah, have you ever WATCHED the real world??? Ever???? Did you really think people wouldn't hook up in the same room as their roommates?? Ughhhhh...... I don't personally agree with everything Bri does either, but she has earned my respect in that she is honest and real about who she is and accepts her flaws and still tries to be a good person. Change for the better isn't an overnight process for ANYONE, it's easy to fall back into comfortable bad habits and I don't know where I was going with this but from what I can see is despite everything, Bri really is a decent person.

Okay, so I have been lurking on this site for a few months now and what brings me to post: talk of IP law! Interesting because I am a law student that plans to practice in the IP field with little interest in copyright. I guess things will change when I take my copyright course next semester but I must say I find it interesting everytime I read your post about different IP issues.
