It definitely makes Kenny and Evan look suspicious that they settled out of court. If you are confident about your innocence, you usually go through the whole legal battle and not just surrender.

Most cases are settled out of court. Many of those cases may have had very little evidence on the part of the plaintiff, but they are settled because lawsuits are expensive. In a case like this the party that loses is responsible for all the court costs of both sides, but a case could incur court costs of tens or hundreds of thousands of dollars. Say Tonya lost. There is no way that she could pay the court costs for MTV/BMP and they would still be on the hook for them. I don't know how much the settlement was for but it was probably a small price to pay in comparison to lawyer fees and court costs that they would not have been reimbursed for even after winning.
In fact, rather than making me think Kenny and Evan were guilty, I would say that the case being settled makes it seem like Tonya did not have enough evidence to prove her case. It is my understanding that MTV/BMP were at the helm of the legal decisions in the case (although I am not sure). Kenny and Evan may have wanted to fight it out to clear their names, but any corporate lawyer worth her salt would point out exactly what I stated above, namely that the case would be expensive for them win or lose. MTV/BMP had an equal amount of incentive to settle regardless of whether or not they had enough evidence to win their case. On the other hand, Tonya had [I]more[/I] incentive to [I]not [/I]settle if she was confident that she would win, but clearly her legal team was not confident so they settled.
I don't know the truth about this case. I guess this is just a long-winded way to say that the fact that a case was settled should never be taken as "proof" the respondent was in the wrong.

Everything is on camera so while they may not have been able to prove exactly what happened... they (BMP) knew something happened, otherwise the unedited footage could have been given to the lawyers and case dismissed.
